1. Who We Are
Adventure Barbados ("we," "us," or "our") is a Barbados‑based luxury travel planning and concierge service that designs, coordinates, and supports bespoke trips to and within Barbados.
2. What This Terms of Service Covers
These Terms of Service ("Terms") set out the rules for using our website and for engaging our trip planning and concierge services (collectively, the "Services").
By using our website, submitting an enquiry, or confirming a booking with us, you agree to be bound by these Terms.
3. Our Services
We provide:
Trip planning, itinerary design, and concierge services for travel in Barbados.
Coordination and booking of third‑party services such as accommodation, dining, transportation, tours, activities, and experiences ("Vendors").
During‑trip support in line with the service tier you select.
We do not provide:
Travel insurance or insurance advice.
Legal, tax, medical, or safety advice.
Airline, immigration, customs, or entry‑clearance decisions.
Specific inclusions and exclusions for each service tier will be confirmed in your written service agreement or proposal.
4. How Booking With Us Works
You submit an enquiry or schedule a discovery call.
We prepare a proposal or service outline with estimated pricing.
You confirm in writing that you wish to proceed and pay any required deposit or planning fee.
We finalize your itinerary, secure reservations with Vendors, and share confirmations with you.
Before travel, you receive a finalized itinerary and any relevant documentation.
We may require that you sign a separate service agreement that incorporates or links to these Terms. In the event of conflict, the signed service agreement will prevail.
5. Pricing, Fees, and Payments
5.1 Service fees
Our professional fees cover our time, expertise, planning, coordination, and during‑trip support, as described in your proposal or service agreement.
We currently operate a duration-based tiered planning‑fee structure for our core trip design services, with packages called Explorer, Curator, and Architect, each with a clearly stated starting price in USD, duration add-ons (+20% per tier), and per‑person add‑ons (+40% of base). Your exact fee and inclusions will be confirmed in your proposal or service agreement before you commit.
Planning fees are generally split into two instalments: 50% due when you sign the agreement (to begin work) and 50% due when your full itinerary is delivered and approved, and are normally non‑refundable because they cover the professional work already completed.
5.2 Third‑party costs
In addition to our service fees, you are responsible for the cost of all third‑party services (for example: hotels, villas, restaurants, transportation providers, tours, and experiences). These may be:
Paid directly by you to the Vendor, or
Paid by you to us so we can pay the Vendor on your behalf.
We will clearly indicate which approach applies in your proposal or invoice.
5.3 Markups and commissions
We may receive commissions or preferred rates from certain Vendors, or apply a reasonable markup to cover handling and coordination. Where applicable, we will aim to incorporate this into the total price presented to you, and we will not apply hidden or surprise fees.
5.4 Currency and methods of payment
All fees and prices quoted on our website and in our agreements are stated in United States Dollars (USD), unless we clearly say otherwise.
Accepted payment methods (such as credit or debit card via Stripe, bank transfer, or other methods) will be communicated to you in writing.
You are responsible for any bank fees, card fees, currency conversion charges, or similar costs charged by your provider.
5.5 Payment schedule and late payments
We will set out your payment schedule (for example, deposit and final balance due dates) in your proposal or invoice.
If payment is not received by the due date, we may pause work on your trip, cancel reservations that are not yet paid for, or treat the non‑payment as a cancellation under our cancellation policy.
6. Cancellations, Changes, and Refunds
6.1 Your right to cancel
You may cancel your booking with us at any time by sending written notice (for example, by email). Our service fees and any Vendor charges are subject to the cancellation and refund terms stated in your proposal or service agreement.
Planning fees are generally non‑refundable, because they cover the professional time and expertise already invested in researching, designing, and coordinating your itinerary. In some cases we may, at our discretion, offer to apply part of a planning fee as a credit towards a future trip within a stated timeframe; any such exception will be confirmed in writing.
When you request a refund, we will:
Acknowledge your request within 1 business day.
Review your request against the applicable service terms, Vendor policies, and this policy.
Aim to make a decision within 5 business days, unless we need additional information or Vendor input.
If a refund is approved, we will normally issue it back to your original payment method via our payment processor (for example, Stripe). Settlement timings depend on banks and card networks, but we will confirm the amount, method, and expected timeframe in writing.
6.2 Vendor policies
Vendor bookings are governed by each Vendor's own terms and conditions (for example, hotel cancellation cut‑offs or non‑refundable advance purchase rates). Where we are able to obtain refunds or credits from Vendors, we will pass them on to you, less any non‑refundable service fees and reasonable administrative costs.
Some Vendor bookings may be fully or partially non‑refundable. We will flag these, where reasonably possible, before you confirm.
6.3 Changes to your trip
We will make reasonable efforts to accommodate changes you request after confirmation (for example, date changes, upgrades, or activity swaps). Changes may:
Be subject to availability.
Incur additional service fees and/or Vendor charges.
We will advise you of any additional costs before making changes on your behalf.
6.4 Force majeure and events beyond our control
Events such as severe weather, natural disasters, public health emergencies, strikes, government restrictions, or other circumstances beyond our reasonable control ("Force Majeure Events") may impact your trip.
In such cases:
We will use reasonable efforts to help you rebook, reroute, or obtain refunds or credits, subject to Vendor policies.
Our service fees for planning and work already performed may remain non‑refundable.
We strongly recommend that you purchase comprehensive travel insurance that covers cancellations, interruptions, medical expenses, and other risks relevant to your situation.
7. Your Responsibilities as a Client
You agree to:
Provide accurate, complete, and up‑to‑date information, including names as per passports, contact details, and any special requirements.
Review and confirm itineraries, quotes, and terms before we proceed with bookings.
Hold valid passports, visas, permits, vaccination records, and any other required travel documents.
Comply with all local laws, customs, and regulations in Barbados and any transit destinations.
Inform us promptly of any issues, concerns, or changes so we can support you.
You are responsible for checking entry requirements, health advisories, and any government travel guidance relevant to your trip.
8. Our Responsibilities and Service Standards
We agree to:
Act with reasonable skill, care, and professionalism in planning and coordinating your trip.
Present information and pricing as accurately as reasonably possible based on the information available at the time.
Communicate clearly about inclusions, exclusions, and any material limitations.
Provide support in line with the level of service purchased, including reasonable response times before and during your trip.
While we carefully select and recommend Vendors, we do not control their operations, staff, facilities, or decisions.
9. Third‑Party Vendors and Our Role
When we recommend or book third‑party Vendors for you:
We act as a travel planner and facilitator.
You will be subject to each Vendor's own terms and conditions.
To the fullest extent permitted by law:
We are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Vendor.
We are not liable for personal injury, death, property damage, or other losses or expenses resulting from any Vendor or from any event outside our reasonable control.
This does not limit any liability we may have under applicable consumer protection laws where such limitation is not permitted.
10. Limitation of Liability
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is not permitted under applicable law.
To the extent permitted by law:
Our total aggregate liability to you arising from or in connection with our Services will be limited to the amount of our service fees actually paid by you for the specific trip giving rise to the claim.
We will not be liable for any indirect, consequential, punitive, or special losses, including loss of enjoyment, loss of opportunity, or loss of profit.
11. Complaints and Dispute Resolution
If you have a concern or complaint:
Contact us as soon as possible so we have a fair opportunity to resolve the issue.
We will acknowledge your complaint, investigate it, and respond with a proposed resolution within a reasonable time.
We aim to resolve matters directly with you. If a dispute cannot be resolved informally, we may agree with you to use mediation or another form of alternative dispute resolution before considering court proceedings.
12. Intellectual Property
Our website, branding, written content, itineraries, and other materials we create ("Materials") are owned by us or used under license.
You may use Materials we provide to you solely for your personal, non‑commercial travel purposes. You may not copy, distribute, adapt, or use our Materials for any other purpose without our prior written consent.
13. Privacy and Data Protection
We collect and use personal information in order to:
Respond to enquiries and manage bookings.
Coordinate reservations with Vendors.
Provide during‑trip support.
We will treat your personal information with care and in line with our Privacy Policy, which is available on our website. By using our Services, you consent to your information being used in line with that Privacy Policy.
14. Website Use
You agree not to:
Use our website for any unlawful purpose.
Attempt to gain unauthorized access to our systems.
Introduce malware or other harmful code.
We may update, suspend, or withdraw our website or any part of it without notice where reasonably necessary.
15. Changes to These Terms
We may update these Terms from time to time. The version posted on our website at the time you confirm your booking or sign your service agreement will normally apply to that trip, unless we have agreed otherwise in writing with you or changes are required by law.
16. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or with our Services are governed by the laws of Barbados.
The courts of Barbados will have non‑exclusive jurisdiction, subject to any agreement to use mediation or other alternative dispute resolution methods.
